IPLEX SERVICES

Trademarks & Designs

We assess trademark clearance, design protection and filing options in the context of your products, brand structure and target markets.

SCOPE & APPROACH

Scope of work

We develop protection and filing strategies for names, logos and product designs, considering clearance, goods and services, target markets and the ongoing needs of the portfolio.

01

Trademark clearance & prosecution

We assess distinctiveness, earlier rights and the relevant goods and services to guide clearance searches, application preparation and trademark prosecution.

02

Design protection & filings

We examine product appearance, drawings and prior disclosures to determine the design filing approach and the scope of protection to seek.

03

International protection & portfolio support

We coordinate overseas filings and advise on renewals and later challenges, including non-use cancellation, with local counsel as needed.

KOREAN IP SYSTEM

Trademarks and designs in Korea

Understand the subject matter and examination process, then explore our related practical insights.

Trademarks: brands and designated goods

Trademarks protect signs that distinguish the source of goods or services. Review distinctiveness, similarity to earlier marks and the goods or services relevant to the business. Protection lasts 10 years from registration and can be renewed in further ten-year periods. Keep actual use aligned with the registered scope.

Related insights

Trademark examination, opposition and consent

When objections arise, assess the sign and goods to consider arguments, narrowing the specification or division. Publication may be followed by third-party opposition. Consent from an earlier owner can be useful where permitted, but statutory conditions and exclusions still apply; consent does not guarantee registration.

Related insights

Designs: product appearance and graphical images

Design protection covers visual features of shape, pattern and color, including qualifying graphical images. Consistent drawings or photographs and descriptions are important to the scope of protection. Rights arise on registration and generally last 20 years from filing. Review earlier designs and filing timing before disclosure.

Related insights

Partial, related and secret designs; partial examination

Partial designs may protect selected product features, while related designs can support a family of variants. Consider secret-design requirements where launch confidentiality matters. Certain articles qualify for partial examination, but registration may still face opposition or invalidation. If disclosure has occurred, separately assess the novelty-exception requirements and evidence.
