Today, ‘Content’ is no longer limited to specific industries. Advances in the Internet and mobile technologies make it easy for people around the world to exchange information, share creations, and produce new content at a rapid pace. 
One of the largest content markets in the world, the U.S. is a place where players from almost every field – music, movies, games, publishing, software, characters, design – compete fiercely. Enrolling in U.S. copyrights in order to effectively exercise the copyrights you have in these environments is a very important strategic choice.
Copyright generally arises automatically when a work is created and fixed. U.S. registration provides additional procedural and remedial benefits, making it an important part of an enforcement strategy.

For U.S. works, registration or preregistration is generally required before bringing an infringement action, subject to statutory exceptions and the refusal procedure. For both U.S. and foreign works, registration timing affects statutory damages and attorney's fees. These rules are separate from the automatic existence of copyright.
Title 17 of the U.S. Code distinguishes copyright protection from registration. Section 411 addresses the litigation prerequisite for U.S. works; section 412 limits statutory damages and attorney's fees according to registration and infringement timing.
Delaying registration until after content becomes successful can reduce available remedies. Registration timing should be considered before publication and distribution.
Meanwhile, as content becomes popular in the market, so does the risk of infringing. If you attempt to register after (already after) an infringement, it is not easy to take advantage of the aforementioned statutory damages system, and the active defense against the infringement can be delayed. This puts them in an unfavorable position in the lawsuit, which also puts more time and money into it.

The meaning and benefits of statutory damages
One of the key ideas in the U.S. copyright infringement case is the Statutory Damages system. When it is difficult to clearly prove what the actual damage is, it is the amount the court imposes on the infringer within the scope of copyright law. For example, whether the breach was malicious or a simple negligence, the court will determine the amount of restitution to the extent specified.

Proving the amount of loss can be difficult in a copyright infringement case. Where the statutory requirements are met, statutory damages may be available without proof of the precise actual loss. Timely registration can also strengthen the owner's position in licensing and dispute negotiations.
Section 412 generally requires registration before infringement begins, subject to its three-month grace period after first publication and other applicable provisions. Late registration can limit these remedies.
Therefore, to protect your work, you must complete the U.S. copyright registration as soon as possible with the creation or publication of your work.
