Copyright Registration: The Application Procedure

Copyright arises when a qualifying work is created. Registration can help establish evidence of rights and support secure transactions. Although registration is not required for copyright to arise, it can provide a clearer basis for asserting those rights in a dispute.

Hello, this is patent attorney Yongduck Kim of IPLEX IP Law Firm.

Copyright is an institution that allows creators to protect their creations and exercise their rights over them. Copyright happens automatically the moment you create a work, but by formally registering it, you can promote the assumption of rights and the safety of transactions. A copyright registration is not a requirement for the effect of a right, but it is a basis for a clearer claim of one's rights in the event of a copyright dispute.
Let’s look at the copyright application process in this article.

Copyright registration process
Confirming eligibility for registration
Identify the relevant category, such as an original work, computer program, related right or database right. The registration procedure and required documents vary by category.
  1. Case in point: "A Publishers" have commissioned copyright registrations to solve the problem of illegal distribution of their e-book content, and have succeeded in stopping illegal distribution after registration.
Application submission
  1. Online application: You can apply through the Korea Copyright Commission's copyright registration website. You will need to submit the required documents in the form of an electronic file, and you will need to authenticate yourself through a certificate.
  2. Offline application: You can visit the committee in person or submit your application by registered mail. In this case, you must fill out and submit the required application form.
Review Stage
Once the application is received, the submitted documents and requirements will be reviewed. Registration is complete if there is no flaw in the documents and requirements, but in the event of a problem, you may be asked to supplement the documents or be rejected. The registration process period is 4 business days from the time all documents are provided.
Registration results
The results of the examination will be notified to the applicant, and a registration certificate will be issued for the work once the registration is completed.
