Patents in the AI industry: OpenAI’s changing strategy and global competition

As artificial intelligence moves rapidly into commercial applications, companies are placing greater emphasis on patents as part of their competitive strategy. The focus has expanded from research and development to the protection of commercially deployed technology. The book describes OpenAI’s move toward a more active patent strategy from 2023 in the context of its earlier open-source orientation.

AI patents are closely related to software patents, and applications may concern different stages of training and inference. Data preprocessing, hyperparameter optimization and real-time analysis are examples of areas in which a technical contribution may be examined for patent protection.
