# Saudi trade marks: filing, deadlines and the Madrid route

Overseas Trademarks 2026.10.01 published IPLEX 6 min read Plan protection before entering the market Businesses entering Saudi Arabia should assess trade mark protection alongside their commercial plans. Familiar filing and examination stages coexist with local representation requirements, religious and public-order restrictions, Hijri-calendar deadlines and a 60-day opposition period. This guide addresses Saudi law; a foreign-language edition does not change the jurisdiction discussed. As at publication, the Madrid Protocol is due to enter into force for Saudi Arabia on 8 October 2026. The forthcoming international route should therefore be distinguished from a route already available on 2 October. Filing and prosecution before SAIP Applications are handled by the Saudi Authority for Intellectual Property, or SAIP. Procedures for trade mark applications filed from 19 December 2023 are conducted through its unified intellectual property platform. The usual sequence is filing, formal and substantive examination, any response or amendment, publication, opposition, payment of registration fees and issue of the certificate. SAIP’s stated service period is 90 days, which is not a guarantee that registration will be completed within that overall period. Examination objections or oppositions may extend the process. Where amendments are required, the stated response period is generally 90 days. Acceptance leads to publication for 60 days; absent opposition, final fees must be paid before the certificate is issued. Illustration 2 — Filing and prosecution before SAIP Representation and powers of attorney An overseas applicant will generally proceed through a local representative and supply a power of attorney. Authentication should be planned with that representative rather than assumed from an old checklist. The Apostille Convention entered into force for Saudi Arabia on 7 December 2022. It is therefore inappropriate to assume that consular legalisation is invariably the only acceptable route. Confirm the applicable authentication requirements and the representative’s current document instructions for the particular filing. Public order and religious considerations Clearance is not limited to searching earlier similar marks. Article 3 of the GCC Trade Marks Law applicable in Saudi Arabia restricts marks contrary to public order or public morals and also addresses national flags and emblems, international-organisation insignia, Red Cross and Red Crescent symbols, and signs identical or similar to symbols of a purely religious character. A proposed name or device should be reviewed for its local social and religious implications as well as for conflicts with earlier rights. A mark that appears unproblematic in the applicant’s home market may require a different assessment in Saudi Arabia. Illustration 4 — Public order and religious considerations Ten years and the Hijri calendar The protection term is ten years, renewable for successive ten-year periods, with the effect of registration running from filing. Saudi time calculations require attention to the Hijri calendar. Its lunar year is approximately 354 days, so a ten-year term must not automatically be entered into a docket as ten Gregorian years. Check the filing and registration records, the applicable local calculation and the exact renewal window with the representative. Administrative convenience is not a sufficient reason to substitute a familiar calendar date. Illustration 3 — Ten years and the Hijri calendar Publication is a separate stage Passing examination does not immediately conclude registration. Publication opens a 60-day period during which third parties may oppose. If the period expires without opposition, the final registration fee is paid and a certificate can be issued. Applicants should budget time for this stage and manage its deadlines separately from examination deadlines. Similar-looking procedures in different countries can involve different time limits and consequences. Madrid protection from 8 October 2026 Saudi Arabia deposited its instrument of accession on 8 July 2026; the Protocol takes effect on 8 October 2026. Eligible applicants with a basic application or registration, including Korean applicants using a Korean basic mark, will then be able to seek Saudi protection through a Madrid designation. The choice between direct filing and the international route will become part of the filing strategy. Madrid registration does not displace Saudi substantive examination. Saudi Arabia has declared an 18-month period for notifying refusal, with an additional provision for opposition-based refusals after that period. Local registrability, response requirements and the risk of objection remain relevant. A workable strategy brings together representation and authentication, cultural and legal clearance, the opposition period, the calendar used for renewals and the choice of filing route.
