Trademarks 2026.10.13 published IPLEX 5 min read A challenge to the Gwangcheon mark On 12 August 2026, the Korean Supreme Court dismissed the appeal in case 2023Hu10736. A fisheries cooperative had registered the Gwangcheon seaweed mark for seasoned roasted seaweed on 29 July 2014. The challenger disputed both its status as a geographical indication and the cooperative’s eligibility. The Patent Court had rejected the challenge on 30 June 2023 in case 2022Heo5713. The Gwangcheon seaweed mark reproduced in the judgment The link between a product and its region The former Korean Trademark Act, before its 2016 revision, governs this case. Although descriptive origin terms and prominent geographical names ordinarily face registration restrictions, qualifying geographical indications could be registered as collective marks. At least one quality, reputation or other characteristic must have a substantial connection with the geographical environment, including natural conditions or human factors. This is more than simply attaching a place name to a product. Reputation built through local activity The Court identified a range of evidence: local history and tradition, inherited production methods, distinguishing characteristics, consumer recognition, price differences and authoritative third-party assessments. These factors require an overall evaluation. Gwangcheon’s established reputation as a distribution centre for traditional seaweed, festivals and promotion by local merchants, and industrial support from Hongseong County supported the finding that the reputation of seasoned roasted seaweed originated in Gwangcheon’s human environment. The Supreme Court upheld that assessment. The applicant’s membership is a separate requirement The former Act limited eligibility to a legal entity composed exclusively of persons commercially producing, manufacturing or processing the relevant goods. The cooperative’s articles concerned local production, quality improvement, coordinated shipments and joint sales; membership required residence in Gwangcheon and participation in seaweed production, manufacture or processing. The lower court considered those provisions, its 34 member businesses at registration, its activities and the statutory purpose of granting fisheries cooperatives legal personality. The Supreme Court found the conclusion correct despite some inappropriate reasoning. Evidence to retain for a regional brand The appeal was dismissed with costs against the challenger. The ruling does not make fame or advertising alone sufficient. Producers should document how the reputation arose from a particular region and retain evidence of collective activity, consumer recognition and production history. The entity’s articles, actual membership and operations must also support its eligibility. Product–region linkage and applicant qualification should be checked separately. The original figure labels and forms are preserved; the text explains the facts and the court’s reasoning.
