Patents 2026.09.16 published IPLEX 4 min read When preparing a patent application, you may have ideas and data about the technology, but you may not have enough time to organize them and write a complete specification. In particular, if the schedule to disclose a new product or new technology is imminent, or if there is a need to secure rights by quickly filing an invention application during the research and development process, it is most important not to miss the timing of filing the application. Filing with a provisional specification can be useful when an application is urgent and a formal specification cannot be prepared in time. The provisional specification application is a system designed to secure a priority filing date by submitting the contents of the invention in a more streamlined manner than a general patent application. However, simply submitting the data does not complete all procedures, and additional procedures are required, such as submitting a formal specification within a specified period. What is filing with a provisional specification? This refers to a system that allows you to write and file a specification in a free format in order to secure the filing date (priority date) as quickly as possible when applying for a patent. For a general patent application, specifications, abstracts, and necessary drawings must be prepared in a prescribed format from the time of application. However, even after completing the invention, there may not be enough time to write the specification in a formal format. For example, The company develops new technology ↓ The technology is scheduled to be presented at a conference tomorrow. ↓ There is not enough time to prepare a formal specification. ↓ First, apply by attaching a provisional specification with research notes, papers, etc. ↓ Secure the filing date first You can use it in these situations. The main point of the provisional specification, as can be seen here, is “to quickly secure the filing date.” When it comes to patents, it is basically very important who applies first. For example, let's say that Company A and Company B each developed similar technology on the same day. Company A: Technology development completed on September 1 Company B: Technology development completed on September 1 ↓ Company A: Filed on September 15th as it took time to prepare formal specifications Company B: Filed on September 2nd as a provisional specification In this case, Company B can secure the filing date first with a provisional specification. This provisional specification is valuable in technological fields where quick filing is important. So what is the difference from a regular patent application? Examination cannot proceed on a provisional specification alone. Submission of a formal specification Typically filed at time of application Submission required afterward What materials can I submit? The free format of submitted materials is the biggest feature of the provisional specification. Instead of writing according to a set specification format, you can submit free-form materials explaining the content of your invention. For example, thesis research notes Technical data Technical documents submitted to international standardization conferences PDF explaining the invention Other materials that can explain the invention These materials may be used if they adequately describe the invention. The Korean Intellectual Property Office has improved the electronic application system to allow submission of general electronic files such as PDF and JPG as provisional specifications. However, attaching just any data does not mean that the effect of the filing date will be recognized; the content of the invention sought to be protected must be sufficiently described in the data. Therefore, it is important to check whether the material contains all the core contents of the invention, considering that it will be written as a formal specification later. Submitting a formal specification after filing with a provisional specification Just because a provisional specification has been submitted does not mean that it can be examined for patent as is. Submission Period: In principle, formal specifications, etc. must be submitted by one year and two months from the filing date. If you do not submit a formal specification within the deadline, the application will be considered withdrawn, so you must adhere to the submission deadline. However, there are many restrictions when submitting formal specifications, etc. through corrections. It is recommended to file a domestic priority claim application within one year from the filing date. Submission Form: Amendment (Amendment Category: Provisional Specification Amendment) or application for domestic priority claim Submission fee: Online: 4,000 won / Paper: 14,000 won Note: The amendment procedure for replacing a provisional specification may be used only once. If the required amendment is not filed by the deadline, the application is deemed withdrawn on the following day.
