Intellectual property rights protect the work of creators and inventors and encourage further innovation. Understanding those rights helps individuals and businesses protect the value of their creations. Understanding the difference between copyright and other intellectual property rights is essential to effectively protect your creations. We hope that both creators and companies can leverage intellectual property rights to maximize the value of their creation, prevent legal disputes, and maintain stable creative activities. Key differences between copyright, patents, designs and trademarks Right Content Subject matter of protection Features Copyright Copyright protects original expression, including literary, musical, artistic and audiovisual works. It arises automatically when a qualifying work is created. The creator has legal rights without a separate registration process, but copyright registration is recommended for dispute or proof of rights. It is a literary, scholarly, artistic expression that requires creativity and expression of ideas and emotions. Copyright generally lasts for the author's life plus 70 years. It protects expression, not the underlying idea. Patents Patents protect technical inventions that meet requirements including industrial applicability, novelty and inventive step. Protection arises through application, examination and registration, and generally lasts 20 years from the filing date. The protection of patent rights is a technical invention using natural laws and must meet industrial availability, novelty, and inventive steps. Patent rights arise through registration. Unlike copyright, a patent can protect a technical solution defined by its claims, rather than merely the expression used to describe it. Design Right Design rights protect the visual appearance of a product, including its shape, pattern and color. Korean registered design protection generally lasts 20 years from the filing date. Protected subject matter includes a product's shape, pattern, color or their combination. A design must satisfy the applicable requirements of novelty, creativity and industrial applicability. Design rights protect qualifying product or image designs, while copyright protects original expression. Trademarks Trademark rights protect signs that distinguish goods or services. In Korea, rights generally arise through application, examination and registration and are renewable for successive ten-year terms. The trademark is the identification mark of a product or service, including symbols, letters, shapes, stereoscopic shapes, and colors. Trademarks must satisfy distinctiveness and other registration requirements. A qualifying logo may also receive copyright protection independently of its trademark registration. Difference between copyright and other intellectual property rights Right When rights arise Subject matter protected Term of protection Copyright Automatically on creation, without formalities Original expression Generally the author's life plus 70 years Patents Registration is required. Technical Inventions 20 years from filing Design Right Appearance of goods Trademarks Signs identifying goods or services 10 years since registration The Importance of Copyright Registration Copyright registration enhances the protection of your creations and serves as important evidence in case of dispute. If you have any questions about copyright registration or other intellectual property rights, it is important to get expert advice. Copyright registration not only protects the rights of the creator, but also plays an important role in the recognition of the creator’s efforts and values. In particular, registered copyright enhances legal protection and allows for rapid resolution in case of dispute. Copyright is not only important to the individual creator, but is also essential to any industry based on creation.
