The six main types of work classified by the United States Copyright Office are: (Literary Works) Work of the Visual Arts Sound Recordings Work of the Performing Arts Audiovisual Works and Motion Pictures Single Serial Issue (Collective Work) U.S. copyright generally arises when original expression is fixed. Registration offers additional legal benefits. Selecting the appropriate work category helps ensure that the application and deposit cover the intended material. Under U.S. copyright law, “Work Type” has a direct and indirect impact on the selection of copyright registration forms, deposit requirements, registration costs, and screening procedures. For example, the information and preparation documents required by the Copyright Office vary depending on whether it is a text-oriented literary work, a performance art work that combines music and lyrics, or audiovisual materials (video, film, animation, etc.). Even the same creations can be mixed in multiple categories, so it is recommended that the creator properly grasp the attributes of his work to clarify the scope of his registration. For example, each choice may vary, such as whether you want to register a music work and the sound file that recorded the music at the same time, whether you want to simply register a book or a lecture manuscript (literary work), or whether it is a visual art work with an architectural design. 6 Major Works Classified by the U.S. Copyright Office (Literary Works) Literary works generally convey narrative, descriptive or explanatory text. Examples include: Novels, Nonfiction, Poetry Textbooks, reference works, directories, catalogs and advertising copy Information compilation, computer programs and databases Literary works are texts written primarily for reading and are not intended for performance purposes. Articles appearing in periodicals may also be registered as literary works, but the entire issue of periodicals, such as magazines and newsletters, is not itself included in the literary work category. Registration of the whole issue of regular publication is carried out in a separate “Single Serial Issue” or “Group Registration of Serial Issues”. Work of the Visual Arts Visual art works are very broadly defined in U.S. copyright law. It covers paintings, graphics, sculptural art and architecture, including: 2D art (painting, drawing, engraving, etc.) 3D art (sculpture, installation, etc.) Applied art (industrial design, fashion design, etc.) Photos, maps, technical drawings Architectural works, including buildings and qualifying plans Examples of architectural works include real buildings, as well as architectural plans and schematics. If you want to register a visual art work, you must select the “Work of the Visual Arts” category. In particular, the concept of “image, graphics, sculpture, photography” is comprehensive, so careful attention is required when setting the scope of registration. It may also require online deposit of visual works or, in some cases, physical deposit. Sound Recordings The medium in which the voice or music is recorded falls under the category of sound recording. This includes audio files (WAVs, MP3s, etc.), CDs, vinyls, cassettes, and digital sound files. According to U.S. copyright law, “musical work” and “sound recording” recorded by performing the music are two separate works. Musical work: music and/or lyrics (including both print and digital files) Sound recording: Recorded and fixed a particular performance. For example, a song written by a composer (Melody and lyrics) corresponds to a “music work”, and a song recorded by a singer (album, MP3) corresponds to a “sound recording”. When registering only sound recording: Select the “Sound Recording” category When registering only the musical composition: select “Work of the Performing Arts.” When registering a music work + sound recording together: Select the “Sound Recording” category (but the same author contributed to both music and recordings, or the copyright owner must own both rights) As such, music works and recordings may have different registration categories, so each registration strategy must be developed when the rights relationship is organized by the music producer, composer, and singer. The same applies when you register a recording with a text (books, lectures, sermons, etc.). Written text only: “Literary Work” Written text and its recorded reading together: “Sound Recording,” where eligible In addition, it is important to note that the sounds fixed to MIDI files, audiovisual materials (movie soundtracks, etc.) are not considered “sound recordings”. Work of the Performing Arts The Work of the Performing Arts includes the following types: Music works (including songs and lyrics) Drama works (film scenarios, drama scripts, plays, etc.) Choreography and pantomime In other words, a work that is performing in front of others or that contains artistic elements organized for the stage is included in the “Work of the Performing Arts” category. Performing-arts works must be fixed in a tangible form, such as a script, notation or audiovisual recording, to receive U.S. copyright protection. Audiovisual Works and Motion Pictures Audiovisual Works means works that display a series of related images in a way that is reproduced through a machine or device, and may include sound together. In the broadest sense, video games, powerpoints, etc. belong here. Video games: characters, backgrounds, animation, dialogue and other audiovisual elements Presentations such as PowerPoint: Displays a series of images in the form of slideshows, and can add voice or sound Motion Pictures, on the other hand, refers to “videos that quickly shift the continuous image to create an illusion of movement” among audiovisual works, and may also include sound accompanying it. Feature Films, Documentary, Animation TV Series, TV Shows, Video When registering for a movie or audiovisual work, you will usually choose the category “Motion Pictures” or “Audiovisual Works”. Examples of films include dramas, short films, and TV drama episodes. Single Serial Issue (Collective Work) You can also register as a single serial issue through the U.S. Copyright Office eCO system. For example, if a periodical is published, such as a magazine, journal, or newsletter, it may be treated as a collective work. All of the following conditions must be met. Must be serial: publication with the intention of continuing publication, such as in magazines, newspapers, and journals Must be a Collective Work: Editing and arrangement of several articles (independent works) in a single issue. The issue must have been published. A serial issue must contain sufficiently original selection, coordination or arrangement to qualify as a collective work. Individual articles may be registered separately in the appropriate category. A collective-work registration may also cover eligible individual contributions owned by the claimant, subject to requirements concerning prior publication and registration. Qualifying group registration options can cover multiple issues. Deposit materials by type of work A registration deposit is a copy or other required representation of the work. The required format and number of copies depend on the work, publication status and applicable registration option. Literary works: an eligible electronic file or the required physical copies Visual art: artwork photos (image files), drawings, portfolios, etc. Sound recording: MP3, WAV, CD, cassette tape, etc. Motion pictures and audiovisual works: eligible video files or physical media Single Serial Issue: the publication itself (one electronic file or one physical copy) Considerations when choosing the registration category 1) When choosing a category for the registration of a work, the actual form of use must be considered. For example, if you created a song to present it, you should decide whether you want to register “music works” and “sound recordings” together. 2) Identify the author and claimant structure of various elements of the work. If you have multiple authors and would like to own copyrights individually, we recommend that you register those categories separately. For example, if the author of an illustration and the author of the content are different in a children's book, if the author of the artwork and the author of the content want to own a separate copyright, the artwork is protected as a visual work and the content is protected as a literary work. Where the eligibility requirements are met, group registration can reduce costs for categories such as photographs, serial issues or musical works.
